WHAT WE ARE WORKING ON NOW:
An exploration on how the “harmless error” doctrine isn’t so harmless–in fact, it’s inappropriately blessing a significant amount of unconstitutional behavior–particularly on the part of prosecutors.
WHAT WE ARE WORKING ON NOW:
We are busy exploring how the judicial system can play more of a role in ensuring prosecutorial accountability in its courtrooms and what structural incentives and disincentives exist to promote a culture of prosecutorial integrity and restraint.
WHAT WE ARE WORKING ON NOW:
Consistent with our view that criminalizing conduct isn’t always the first or best solution to a serious problem, we are looking into civil law remedies to address instances of proven prosecutorial misconduct.
