In Brief

Due Process Institute is keenly aware that violations of due process rights will continue without adequate accountability measures in place to protect these rights. Our work encompasses a wide variety of much-needed reforms including returning to an enforcement climate in which ethics, fairness, and restraint are valued and exploring how to identify and effectively address instances of police and prosecutorial misconduct once they’ve occurred.

Specifically, we believe that instance of misconduct must be adequately tracked on a local and national level. Without more understanding of the problems, generalized training initiatives will not be successful.

We support the abolition of, or reform of, the judicially created doctrines of absolute and qualified immunity. We also believe that “harmless error” jurisprudence has unfortunately led to the blessing of significant unconstitutional behavior on the part of government actors.
