This law now limits the IRS' ability to seek forfeiture of someone's money or property in situations where the only suspected crime is "structuring" (rather than some other actual crime) for which the "structuring" was used to conceal wrongdoing. This law brings an end to situations in which the IRS was unfairly seizing profits from lawful cash-operated businesses (like a farm stand or seasonal ice cream stand) simply because they "structured" their daily cash bank deposits to be under $5,000 a day. This bill will not prevent seizure of ill-gotten gains related to criminal activity.
With our help, the RESPECT Act was incorporated into the Taxpayer First Act and signed into federal law on July 10, 2019.
